Understanding Consent Requirements for Marketplace Enrollment

Before assisting a consumer with their Marketplace coverage, agents are required to obtain clear and documented permission from the consumer. This ensures the consumer understands and agrees to the agent’s involvement in handling their personal and enrollment information.

As of late 2024, CMS introduced new safeguards to prevent unauthorized access or changes to consumer applications. These include systems that restrict agent association without verified consumer interaction, such as a recorded three-way call, to reduce the risk of fraud. Consent must be captured and retained in a verifiable way. Acceptable formats include signed forms (paper or electronic), secure emails or texts with explicit consent, or audio recordings from calls.

  • Collecting Personal Information (PII)
  • Looking Up Applications
  • Helping with Applications
  • Enrolling in Coverage
  • Making Changes
  • Checking Enrollment Status
