Understanding Consent Requirements for Marketplace Enrollment

Before assisting a consumer with a Marketplace application, enrollment, account maintenance, or other Marketplace-related activity, agents must obtain and document the consumer’s consent. Agents must also document that the consumer has reviewed their eligibility application information and confirmed its accuracy before the application is submitted. CMS permits multiple methods of documenting consent and application review, provided the documentation can be maintained and produced upon request.

Sample Consent and Eligibility Application Review Templates

CMS allows consent and application review documentation to be maintained in various formats, including signed paper forms, electronically signed documents, secure email or text communications, and recorded telephone conversations where permitted by applicable state law. Agents are responsible for retaining documentation in accordance with CMS requirements.

You must obtain and document consumer consent before performing any of the following activities:

• Accessing, collecting, or using a consumer’s personally identifiable information (PII)
• Searching for or accessing an existing Marketplace application
• Assisting with a Marketplace eligibility application
• Assisting with enrollment in Marketplace coverage
• Making changes to a consumer’s Marketplace application or enrollment
• Providing ongoing account maintenance or enrollment assistance
• Communicating with the Marketplace on behalf of a consumer
• Checking application or enrollment status information
